Sellers Disclosure
This step has a two-fold purpose. First you are required by law to provide a buyer with a seller's disclosure during the contract process. Second it can bring to light things which might be best fixed before going on the market.
The law states that a seller has a duty to inform the buyer of residential property about any known property defects that affect the property's value.
A seller cannot be held liable if there is no knowledge of any defects. However it can be touchy if there is a perception of knowledge. It is always easiest to go ahead and disclose anything which might be conceived as a defect.

Types of Physical Defects:
- Roof Problems
- Electrical, Plumbing and A\C Problems
- Structural
- Sink Holes--New separate disclosure required if you have ever had a sink hole.
- Water Drainage--Flood Zone--We check this for you.
- Wood Rot
- Termite Damage--This is addressed in the contract.
- Environmental Pollution
- Pool Problems
Any of these type physical defects which were professionally repaired with permits are no longer considered defects.
Other type of defects.
Knowledge of changes in the surrounding area- Such as learning that a
trash hauler is building a truck facility across the street.
Knowledge of coming special assessments. Mostly for Condos, but also
home owner associations.
Knowledge of any upcoming litigation which involves the property. This
is addressed in the contract.
Knowledge of any disputed property lines.
This is not a complete list but will give you food for thought. As you see, your knowledge is the key here; you are not responsible for not knowing. However, if you even think there might be a defect, it is much easier to reduce the price accordingly rather than pay an attorney fees whether you win litigation or not. Not to mention having to pay for fixing the defect if you were to lose. Unless of course you enjoy a good lawsuit. (-:
Most Real Estate Agents don't start this step until they have to present it to a potential buyer and then scramble to get everything together. I like to get things started in the beginning so that everything goes smoothly once we put your property on the market.
